Eleven families sue former Toledo children's doctor and his hospitalOnce familias demandan a exmédico infantil de Toledo y su hospital

Eleven families have sued Dr. Bryan Shanley Sack, the former chief of pediatric urology at Nationwide Children's Hospital-Toledo, and the hospital itself. They say he photographed their children during medical appointments. Six of the families are from the Toledo area. The suit was filed Wednesday in federal court in Detroit.

The families say the hospital did not supervise him properly. Its own rule required another staff member in the room during exams. That rule was not enforced, the suit says. He worked 18 months at the Toledo office. The suit seeks to cover every child he saw there, an estimated 1,000 to 2,500. It asks for damages. It also asks the hospitals to tell every patient he treated.

Sack was arrested Feb. 21 on state charges. A federal grand jury indicted him in May on two child-pornography counts. David Champine, the families' lawyer, said the parents do not know what the images show. They cannot tell whether their own children are in them. "That's the most anxiety-driven part of this for everyone," he said.

Nationwide fired Sack four days after his arrest. It said again Friday that police have told it the charges are not tied to his medical work. Mercy Health St. Vincent Medical Center leased the space to Nationwide. It is also named in the suit. It did not answer a request for comment Friday.

A landowner south of Detroit Metro Airport lost her appeal seeking payment for trees the airport authority cut on her property. A state appeals panel ruled Nov. 3 that removing trees that broke an airport safety limit did not require payment in this case.

Michelle Baldwin argued that the Wayne County Airport Authority took her property without paying her and entered her land unlawfully. The Michigan Court of Appeals upheld the rejection of both claims. It found that removing the flight hazard was a lawful public function and that the authority was shielded from the trespass claim.

Both sides agreed that several trees rose more than 50 feet above the airport’s elevation. That was the limit for Baldwin’s property on Vining Road. That is not a blanket limit of 50 feet measured from the ground beneath each tree.

The ruling has limits. The panel said it did not give the authority free rein to cut every tree without paying. It also assumed the disputed trees had grown past the limit after the rule took effect in 2016. The parties had not developed that question in the case.
