A Lucas County judge has barred Oregon City Council Member Dave Andrus from votes on the city's data-center project. A hearing Friday will decide whether the ban lasts longer.

So far the order has changed little. The one council meeting it has covered, on Monday, had no data-center legislation on its agenda.

The group suing the city wants more. It asked the court to keep Andrus from casting any council vote until the lawsuit ends.

The stakes are the data-center deal. Vantage Data Centers wants to build a 316.8-megawatt campus on land the city is selling at Wynn and Corduroy roads. On Sept. 28, it asked a council committee to send the deal to a council vote by Oct. 26. On Nov. 3, Oregon voters decide Issue 25, a charter amendment that would ban data centers over 25 megawatts.

Judge Dean P. Mandros of Common Pleas Court signed the order Oct. 9. Through Oct. 16, Andrus cannot vote on anything “relevant to Data Center matters or Capacity, LLC matters, including zoning issues.” Capacity is the company buying the city's land for the project. His other council votes are not affected.

The appointmentEl nombramiento

Andrus holds the seat Salander gave up to become mayor. The minutes of the Dec. 8, 2025 meeting, filed with the lawsuit, show how he got it: under further business, Steve Hornyak said the city had a vacancy, moved to appoint Andrus to the seat through Dec. 31, 2027, and Kathy Pollauf seconded. The roll call was 4-2. Hornyak, Pollauf, Dennis Walendzak and then-Council President Terry Reeves voted yes; Beth Ackerman and Paul Drake voted no. The meeting adjourned at 8:09 p.m.Andrus ocupa el puesto que Salander dejó para ser alcalde.

The name was new to the two who voted no. “This is the first I’ve heard this name,” Ackerman said, according to a transcript of the meeting the group filed with the court, and she asked to table the motion or discuss it. She then asked the others whether they had heard it before. In the transcript, Reeves, asked whether he was aware, answered, “Yes, I was,” and Walendzak said more than 20 people had contacted him over the month and Andrus was one he spoke with. “That’s four of you,” Ackerman said. “Is that a sunshine violation?” A member on the other side answered that “they would have to meet to violate the sunshine laws.” Another answer in the transcript says Andrus had been on the board of zoning appeals for 14 years.

What the suit wantsQué pide la demanda

Responsible Government 4 Oregon LLC sued more than seven weeks later. The complaint calls it a nonprofit company formed “by concerned residents of Oregon seeking to ensure an open government” and names one member, James Davis, who signed it and had spoken at council about the data center. The city says state records show the company was formed Jan. 7, 2026, 22 days before it sued, with its lawyer listed as its agent. The complaint gives the lawyer’s Maumee office as the company’s address.

The suit says the four council members it names settled three things in private before any public vote: a payout the suit puts at more than $25,000 for City Administrator Joel Mazur, who resigned Nov. 24, 2025; Andrus’s appointment; and, added in March, the revival of the Feb. 9 extension for the data-center developer after the vote had been announced as failed. That, it says, violates Ohio’s Open Meetings Act. The city denies all three. It says a personnel matter needed no council vote, that some members “had discussions about potential candidates” but not a majority of council, and that the Feb. 9 result was “mistakenly announced.” Its lawyers wrote that the council members “take no position” on data centers.

What the group asks for goes well beyond Friday. It wants the court to declare Andrus’s appointment void, to treat every vote he has cast since Dec. 8 as void, to keep him from counting toward a quorum, to order council to fill the seat lawfully, to void the February extension ordinance, and to award the group its legal fees. Its October motion says what it is trying to stop: a council approval of the data-center deal before the Nov. 3 vote, which it says the developer could then claim as grandfathered. It says the council majority wants the deal approved before voters weigh in, and that Andrus’s vote would let that majority override a veto by the mayor. “The bell cannot be unwrung,” its lawyer wrote.

The city’s lawyers call the motion “political gamesmanship” aimed at the election, filed 10 months after Andrus took the seat and meant “to gain some political advantage.” They argue the suit took the wrong legal road: Andrus is at least a de facto council member whose votes count until a separate court action, called quo warranto, removes him, and a suit like this one cannot do that. They also say the city sent the group a settlement offer June 18 with “serious non-monetary proposals which would affect the composition of the Oregon City Council,” and that the group neither accepted nor rejected it. The group’s lawyer replied that the council members had kept up “backroom” talks about the seat since the suit was filed and that the city’s filing was “political grandstanding.”Los abogados de la ciudad califican la moción de “juego político” dirigido a la elección, presentada 10 meses después de que Andrus asumiera el puesto y con el fin de “obtener alguna ventaja política”.

The court’s May 26 scheduling order set trial for Nov. 10. The city asked in August to push every deadline back 90 days because no discovery had been done, and the group did not object. The city’s lawyers wrote this month that the dates are being extended, with an order expected to follow.

The mayor drew his own line in September. “I will not bring forward any legislation to council for a vote on any items prior to the general election,” Steven Salander told a council committee Sept.

Andrus, his lawyers and the group's lawyer did not respond to emailed requests for comment sent Tuesday afternoon.
